Carmi Police Chief Addresses Residents’ Concerns about Recent Plea Agreements

CARMI – After getting several phone calls and messages from concerned residents about recent plea agreements in the White County Court System, Carmi’s police chief released a statement Thursday explaining that police are typically not involved in the court process and plea agreement process and normally have no knowledge of the plea agreements until they are made public.

Jason Carter says they work hard to develop evidence and make solid cases on incidents that occur, but sometimes, some cases just can’t develop into good solid cases for prosecution. He says the recent cases that so many were concerned with were not some of those cases. Police usually find out about the outcome of cases just as the public does via online court documents and when suspects are released from detention.

Some citizens have specifically asked Chief Carter about the misdemeanor charges of offenses and felony charges and why they are like this. The chief says they have no control over the statutory assignments of charges as this is set by the Illinois Legislature and not the state’s attorneys, judges or law enforcement. Police have to follow the constitution and guidelines of the Illinois Criminal Code Statutes set forth by the state legislation. Sometimes the only way to make sure certain elements are met that are necessary is the chance what is charged according to the chief. And sometimes that entails having to charge a misdemeanor instead of a felony. He says they have no input into or knowledge about plea agreements unless advised by the State’s Attorney’s office.

Again, Chief Carter appreciates the community’s concern and those who have called to inquire about recent cases. The chief says when outcomes of cases are released that aren’t favorable to victims and the community, the law enforcement community becomes just as upset and outrages as the public. He says they strive to fulfil their duties and always have a genuine concern for the victims.
